M. Andrew Nester

Commonwealth’s Attorney, M. Andrew Nester, is a native and lifelong resident of Henry County. Nester graduated from Bassett High School in 1998 and obtained a Bachelors of Arts degree, magna cum laude, in criminal justice from Ferrum College in 2002. In 2005 Nester graduated from the Appalachian School of Law, suma cum laude, and became an Assistant Commonwealth’s Attorney for Henry County in November of the same year. He assumed the role of Commonwealth’s Attorney on July 1, 2013. Nester supervises a staff of four Assistant Commonwealth's Attorneys, an office administrator, three support staff, and three members of the Victim-Witness Program.


As the Commonwealth's Attorney, Nester is responsible for prosecuting a wide variety of felonies, misdemeanors and traffic infractions in the Circuit and District Courts. The cases range from minor traffic infractions to complex financial crimes, arson, robberies, homicides, and larcenies, just to name a few. Nester also serves on the Southern Virginia Internet Crimes Against Children Task Force. 

Having a strong passion for community service, Nester joined the Collinsville Volunteer Fire Department in 2002, and served as its chief in 2012 and 2013.  He is a certified Fire Instructor, Fire Investigator, and EMT-B. He additionally holds various other certifications in the fire and EMS fields.

Dawn M. Futrell

Dawn Futrell has been an Assistant Commonwealth's Attorney for Henry County since 1997.  She is originally from Chesapeake, Virginia and graduated from Virginia Wesleyan College in 1988 with a BA in Political Science. She graduated from Duke University School of Law in 1991. Her husband, Bruce Updyke, is a Methodist minister and she has one stepdaughter, Melody, who lives in Cary, NC.

When she's away from the office her interests are sports, church, and travel.

Jessica S. Henson

Jessica S. Henson was born and raised in Henry County, Virginia.  She graduated from Greensboro College in December 2008 with a BS in Political Science.  In 2012, she graduated from the Cumberland School of Law, Samford University in Birmingham, Alabama.  In November of 2012, she began practicing at The Estate & Elder Law Center of Southside Virginia.  Jessica joined our office as an Assistant Commonwealth’s Attorney in March 2015.

Wayne O. Withers, Jr.

Wayne Withers, Jr. has been an Assistant Commonwealth’s Attorney since 1994. Wayne was born in Charlotte, North Carolina and raised in south Florida. He graduated from Florida Atlantic University in 1983 with a BS in Biology and Washington and Lee University School of Law in 1988.

Awbrey J. Watts

Awbrey J. Watts was born in Westminster, California and raised in Riverside, California.  She graduated from the University of California, San Diego in 2003 with a B.A. in Human Development.  In 2007 she graduated from Thomas Jefferson School of Law, cum laude.  Awbrey became a member of the California Bar Association in 2008 and worked for a private Immigration firm in Irvine, California until 2010. That October Awbrey became a Magistrate working in Henry County and the following year became a member of the Virginia Bar Association.  She joined our office as an Assistant Commonwealth’s Attorney in June 2014.
